1. Acceptance of these terms

This website is operated by the rowing program of Catawba Yacht Club ("CYC Rowing," "we," "us"). By accessing or using this site you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use the site.

2. Who we are and what this site is for

This site provides information about our masters rowing program, Learn to Row sessions, regatta participation, safety practices, club news, and how to get involved. It is an informational resource only. Nothing on this site is an offer of membership, a guarantee of a seat in a boat, or a contract for services.

3. Membership and program participation

• Participation in rowing activities requires current Catawba Yacht Club membership in good standing, unless otherwise stated for a specific introductory program.
• All participants must complete any required USRowing membership, waiver, and release forms before going on the water.
• Rowers must satisfy the program's swim and water-competency expectations and follow all coach, coxswain, and safety-officer instructions.
• Schedules, fees, session dates, and program offerings described here may change. The information communicated directly to members controls if it differs from this site.
• We may decline or discontinue participation where safety, capacity, conduct, or club rules require it.

4. Assumption of risk

Rowing is a physical outdoor sport conducted on open water. It involves inherent risks including capsize, immersion, collision, equipment failure, weather and lightning exposure, powerboat traffic, heat and cold illness, overuse and back injury, and in rare cases drowning or death. You are responsible for assessing your own fitness and medical readiness, and we recommend consulting a physician before beginning any rowing or training program. Information on this site about technique, training, or safety is general in nature and is not medical, coaching, or professional advice for your individual situation.

5. Conduct on the water and on club property

All participants are expected to follow club rules, posted traffic patterns for Lake Wylie, North Carolina and South Carolina boating regulations, and our safety protocols. Equipment is shared: damage must be reported promptly, and boats, oars, and launches must be returned clean and properly stored. Harassment, abuse, and misconduct are prohibited; our SafeSport commitments apply to all program activity.

6. Acceptable use of this website

• Do not attempt to gain unauthorized access to any part of the site, member area, or administrative tools.
• Do not scrape, republish, or resell site content, or use it to train commercial models without permission.
• Do not submit unlawful, misleading, infringing, or abusive content through any form on this site.
• Do not interfere with the operation or security of the site.

7. Accounts and member content

Some areas require an account. You are responsible for keeping your credentials secure and for activity under your account. If you submit content — news copy, photos, results, or comments — you confirm you have the right to share it and you grant us a non-exclusive, royalty-free license to publish it in connection with the club and its programs. We may edit or remove submitted content at our discretion.

8. Photography and media

Photographs and video are frequently taken at practices, regattas, and club events and may be used in club communications and on this site. Member photo albums are private to members and are not linked publicly. If you prefer not to appear in publicly posted images, contact us and we will honor that request going forward.

9. Intellectual property

The Catawba Yacht Club name, burgee, logos, and the text, photography, and design of this site are owned by the club or its contributors and are protected by copyright and trademark law. You may view and print pages for personal, non-commercial use. All other use requires written permission.

10. Third-party links and services

This site links to third-party resources such as USRowing, regatta registration platforms, partner programs including Charlotte Youth Rowing, weather services, and the other Catawba Yacht Club sites. We do not control those services and are not responsible for their content, availability, or practices. Their own terms and privacy policies apply when you use them.

11. Payments, dues, and fees

Dues, program fees, and any amounts described on this site are stated for information only and are collected under club policy. Refund and cancellation terms for a specific program are communicated at registration and control over anything stated generally here.

12. Disclaimers

The site is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Weather, water-condition, schedule, and results information may be delayed or incorrect and must never be your sole basis for a safety decision. Always verify conditions yourself before launching.

13. Limitation of liability

To the fullest extent permitted by law, Catawba Yacht Club, its rowing program, and their officers, coaches, volunteers, and members are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this site or your reliance on its content. Nothing in this section limits any liability that cannot be limited under applicable law, and these terms do not replace or modify any signed waiver, release, or membership agreement.

14. Indemnification

You agree to indemnify and hold harmless the club and its volunteers from claims arising out of your misuse of this site, your breach of these terms, or content you submit.

15. Changes to these terms

We may update these terms as programs, policies, or legal requirements change. The effective date above shows the most recent revision. Continued use of the site after an update means you accept the revised terms.

16. Governing law

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts serving Mecklenburg County, North Carolina.
